NARRATIVE/JUSTIFICATION FOR JUDGMENT OF COMPLIANCE

The University's policies in relation to intellectual property are clear and apply to students, faculty, and staff. Texas A&M International University under The Texas A&M University System Policy 17.01, Intellectual Properties, Policy 17.02.01, Management of Intellectual Property, Policy 17.02.02, Technology-Mediated Instruction maintains that all rights in "copyright shall remain with the creator of the work unless the work is supported by a direct allocation of funds ... for the pursuit of a specific project, is commissioned by the System ... or otherwise subject to contractual or legal obligations, or is a 'work made for hire' as that term is defined in the Copyright Law." (see also Faculty Handbook, 2.32 B, H).

To make students aware of their responsibilities concerning copyrighted materials, the faculty include in their syllabus the citation for copyright restrictions which states:

The Copyright Act of 1976 grants to copyright owners the exclusive right to reproduce their works and distribute copies of their work. Works that receive copyright protection include published works such as a textbook. Copying a textbook without permission from the owner of the copyright may constitute copyright infringement. Civil and criminal penalties may be assessed for copyright infringement. Civil penalties include damages up to $100,000; criminal penalties include a fine up to $250,000 and imprisonment.

Thus, policies are clear concerning ownership of materials, compensation, copyright issues, and the use of revenue derived from the creation and production of all intellectual property. These policies apply to students, faculty and staff.
